Alternative Dispute Resolution for SMEs

How Can Alternative Dispute Resolution Help Small Businesses?

It is unfortunate but inevitable that businesses will become involved in disputes and disagreements at some point in their lifecycle. This can happen at any stage from startup through to exit and it’s the reason that having a strong legal framework for your business across your corporate documents, commercial engagements and employment agreements is so important.

However, sometimes disputes are unavoidable and it’s for this reason that Dragon Argent are delighted to introduce our new Head of Commercial Litigation, Margherita Barbagallo.

We asked Margherita, commercial litigation lawyer to share some thoughts about why she feels it is so important for founders to focus on resolving disputes rather than using the court system. She said “litigation through the courts can be time-consuming, costly, and stressful to resolve. It can take your focus away from the performance of the business and drain your emotional energy. It is for these reasons that it is critical for SMEs to bring stakeholders together to engage in constructive dialogue early in the process to reach an appropriate solution.”

There are many methods of dispute resolution available outside of the courtroom (including arbitration, adjudication, expert determination, mediation, or just simple negotiation). These are often far quicker, cheaper and more effective than the traditional litigation route. It’s the reason we’re so pleased at Dragon Argent to have added this crucial competency to the team – so that we can help clients resolve disputes in the most cost effective, efficient way possible.

Margherita has extensive experience in all methods of dispute resolution as well as with court litigation. She can provide astutely tailored advice and takes a uniquely pragmatic and creative approach to help find the best commercial outcome for her clients. Importantly, she is also adept at advising on elements of risk in transactions at the earlier stages to protect businesses from disputes arising altogether. Whether advising from a preventative or remedial approach, she is well placed to help.

Margherita finished by saying, “our dispute resolution lawyers in London prides itself on offering a bespoke solution to resolve client disputes and avoid costly litigation. However, when litigation is unavoidable, the team is fully equipped to navigate clients through that process.”

Margherita can support your business with, among other things:

  • Shareholder/founder disputes

  • Intellectual property claims

  • Contract disputes

  • Debt recovery

  • Regulatory compliance including data protection/GDPR issues

If your business is currently facing a dispute or would like to future-proof itself against any impending disputes, get in touch with our commercial litigation services in London by booking a discovery call with Margherita and she would be delighted to have an initial discussion with you.
